Data protection policy for Audi connect

Legal notes according to the Telemedia Act for Audi connect.

Audi Canada collects, processes, transmits and uses certain types of personal data as provided for by law, insofar as this is necessary to provide informational and operational services for your vehicle on the data server ("Audi connect services" or "services") and to enable the user to use the service. Further information on the type, scope and purpose of this data processing is given in the following note on data protection for the services specified below. We therefore request that you read the following information carefully.

For the purposes of this data protection policy, personal data are considered to be information on your personal or material circumstances. This means information which could be used to help identify a person or which could be linked to a specific person. Audi Canada only collects, uses, processes or forwards personal data if this is permitted by law, in accordance with this policy, Audi Canada’s Privacy Policy or if the user has otherwise consented to the data collection, use, processing and/or transmission. You can deactivate the collection of certain personal data via the privacy settings. The deactivation means that services using these data cannot be provided and therefore cannot be used. Please note that the emergency call service cannot be deactivated using this function and still sends the data necessary to provide the services. In addition, the Audi connect key can, for safety and security reasons, only be deactivated via the privacy settings if no keys are assigned. This means that it will still be possible to use the Audi connect key if keys are assigned.

1. Collection and processing of personal data:

Audi Canada collects, processes, transmits and uses certain types of personal data as provided for by law, insofar as this is necessary to provide the content and to enable the user to use the relevant service:

Fuel prices:

For the fuel prices service, this concerns the following data: the time at which the service is accessed and the type of request which you have made via the MMI, the vehicle identification number (with which your vehicle can be clearly identified and attributed to a particular vehicle keeper), the vehicle position (location data) and/or the item which you have personally specified (search term), as well as the type of fuel(s) relevant for your vehicle.

To provide the fuel prices service, we process/use the data specified above in order to be able to display the filling stations near your current position or your destination. The time at which the service was accessed, a possible search item, and the vehicle identification number are additionally stored for a short time for the purposes of error analysis.

Insofar as is necessary to provide the service, the data are forwarded to our service provider OPISNAVX c/o IHS,
18 rue du Quatre Septembre, 75002 Paris, FRANCE. The service provider uses the data solely to provide the service and deletes the data after the service has been used. The data are not distributed to third parties.

Online news:

To be able to use the service, please log in in your vehicle using your myAudi login data (user name [e-mail address] and password). If you store your myAudi login data in the vehicle, you will in future be logged in automatically to use the service, i.e. you will not need to re-enter your login data. For automatic login, you must have the mobile phone stored in myAudi with you. Please note that the personalized service is also accessible to third parties if you provide these persons with your mobile phone (and your myAudi PIN, if you have set one).

The Audi connect service online news is a personalized service. This means that a separate and individual myAudi account must be registered and opened to use the service. You can configure the service in your myAudi account and transmit certain data and content required for the functions of your Audi connect services to your vehicle (via your mobile network connection) and also allow certain vehicle data to be transmitted from the vehicle to us or to the service provider (as described below).

The following data are used when the online news service is accessed: The time at which the service is accessed and the type of request which you have made via the MMI, the vehicle identification number (with which your vehicle can be clearly identified and attributed to a particular vehicle keeper) and your myAudi user name.

These data are only used to enable access and use of the service. You can transmit data stored in your myAudi account for the online news function to your vehicle (e.g. RSS feeds you have stored in myAudi). The time at which the service was accessed and the vehicle identification number are additionally stored for a short time for the purposes of error analysis.

Audi Canada merely enables you (as part of Audi connect) to use the communication/information service which you have separately obtained from online news ("service provider") in the vehicle. We forward the identification data entered by you (user name and password) to the service provider accordingly so that the service provider can allow you access to the service and provide the service as part of the connect services portfolio. The identification and connection data needed to do this are processed and used to provide the service and to ensure the proper functioning of the services according to the applicable legal requirements. Your identification data for the use of the personalized information service are stored by Audi Canada so that you do not have to log in each and every time you wish to use the service.

The usage conditions (and, if applicable, the data protection notes associated with them) which have already been agreed between you and the service provider apply in the case of further data processing as part of the use of the service.

Current information from the service provider (especially in relation to the imprint, the usage conditions which may apply to the services as well as in relation to possible data processing by the service provider) may be available on the website of the service provider (specified below):

News: www.afp.com, www.npr.com and any further providers of RSS feeds added by the user.

Parking information:

For the parking information service, this concerns the following data: the time at which the service is accessed and the type of request which you have made via the MMI, the vehicle identification number (with which your vehicle can be clearly identified and attributed to a particular vehicle keeper), the vehicle position (location data) and/or the item which you have personally specified (search term).

To provide the service, we process/use the data specified above in order to be able to display unoccupied parking spaces and multi-storey car parks near your current position or another location. The time at which the service was accessed, a possible search item, and the vehicle identification number are additionally stored for a short time for the purposes of error analysis.

Insofar as is necessary to provide the service, the data are forwarded to our service provider

Travel information:

For the travel information service, this concerns the following data: the time at which the service is accessed and the type of request which you have made via the MMI, the vehicle identification number (with which your vehicle can be clearly identified and attributed to a particular vehicle keeper), the vehicle position (location data) and/or the item which you have personally specified (search term).

To provide the service, we process/use the data specified above in order to be able to provide you with information about landmarks at your destination or at another location. The time at which the service was accessed, a possible search item, and the vehicle identification number are additionally stored for a short time for the purposes of error analysis.
Insofar as is necessary to provide the service, the data are forwarded to our service provider; Neofonie GmbH, Robert-Koch-Platz 4,10115 Berlin. The service provider uses the data solely to provide the service and deletes the data after the service has been used. The data are not distributed to third parties.

Travel:

With every user request in the travel service, the time the service was accessed and the vehicle position (location data) and/or the position that you have personally specified (search position) is transmitted to our service provider (see below). Information on whether you have entered the vehicle position or a search position is not transmitted. You can also transmit other search parameters such as selected search categories (e.g. "Museums", "Castles" etc.), a specific search term (direct entry by the user) or additional filter settings (e.g. "churches only" etc.).

To provide the travel service, we process/use the data specified above in order to be able to provide you with information about landmarks at your destination or in a search area specified by you. The service enables you to access commercial travel guide content from our service provider (see below) via an app installed on your personal mobile device. This content can be requested both on the mobile device and in the vehicle if a Wi-Fi connection between the mobile device and the vehicle is active. You can also store individual travel destinations in advance by storing them locally on the mobile device and calling them up from the storage device in the vehicle later.

Insofar as is necessary to provide the service, the data are forwarded to our service provider Wcities.com, Inc., 512 2nd Street Second Floor, San Francisco, CA 94107, USA – www.wcities.com. The service provider uses the data solely to provide the service and, if necessary, to deal with system faults and deletes the data after the service has been used or the fault has been resolved. The data are not distributed to third parties. The data are anonymized before they are transmitted to the service provider. This means that the data transmitted to the service provider cannot be linked to a specific person.

Twitter:

To be able to use the service, please log in in your vehicle using your myAudi login data (user name [e-mail address] and password). If you store your myAudi login data in the vehicle, you will in future be logged in automatically to use the service, i.e. you will not need to re-enter your login data. For automatic login, you must have the mobile phone stored in myAudi with you. You can configure the service in your myAudi account and transmit certain data and content required for the functions of your Audi connect services to your vehicle (via your mobile network connection) and also allow certain vehicle data to be transmitted from the vehicle to us or to the service provider (as described below).

The following data are used when the Twitter service is accessed: The time at which the service is accessed and the type of request which you have made via the MMI, the vehicle identification number (with which your vehicle can be clearly identified and attributed to a particular vehicle keeper), your myAudi user name and location information for some functions of the service.

These data are only used to enable access and use of the service. You can transmit data stored in your myAudi account for the Twitter functions to your vehicle (e.g. text templates for personal post or templates you have added in myAudi) and allow certain vehicle data to be transmitted from the vehicle (e.g. personal status updates etc.). The time at which the service was accessed and the vehicle identification number are additionally stored for a short time for the purposes of error analysis.

Audi Canada merely enables you (as part of Audi connect) to use the communication/information service which you have separately obtained from Twitter ("service provider") in the vehicle. We forward the identification data entered by you (user name and password) to the service provider accordingly so that the service provider can allow you access to the service and provide the service as part of the connect services portfolio. The identification and connection data needed to do this are processed and used to provide the service and to ensure the proper functioning of the services according to the applicable legal requirements. Your identification data for the use of the personalized information service are stored by Audi Canada so that you do not have to log in each and every time you wish to use the service.

For the weather service, this concerns the following data: the time at which the service is accessed and the type of request which you have made via the MMI, the vehicle identification number (with which your vehicle can be clearly identified and attributed to a particular vehicle keeper), the vehicle position (location data) and/or the item which you have personally specified (search term).

To provide the service, we process/use the data specified above in order to be able to provide you with information about the weather at your current location or your destination. The time at which the service was accessed, a possible search item, and the vehicle identification number are additionally stored for a short time for the purposes of error analysis.

Insofar as is necessary to provide the service, the data are forwarded to our service provider; Meteo-Group Deutschland GmbH, Am Studio 20a, 12489 Berlin. The service provider uses the data solely to provide the service and deletes the data after the service has been used. The data are not distributed to third parties.

Point of interest (POI) search with speech control, online traffic information and destination input via myAudi:

Each time a service is accessed, data are stored and processed. These data may, for example, concern the time at which the service was accessed and the type of request made via the MMI, the vehicle identification number (with which your vehicle can be clearly identified and attributed to a specific vehicle keeper), the vehicle position (location data) and/or the item which you have personally specified (search term).

Navigation with Google Earth™/navigation with Google Maps™ satellite images:

With this service, only the vehicle position (location data) and the zoom level/direction of travel are used. This is to provide you, in combination with the information on the road network from your navigation program, with a map service that is as realistic as possible or satellite images to be displayed on the map. An anonymized “session ID” is generated to connect the vehicle to the service provider. This allows the service provider to assign the journey by technical means. The session ID is deleted after the service has been ended.

Online traffic information:

With this service, only the vehicle position (location data), speed and destination data are used. An anonymized “session ID” is generated to connect the vehicle to the service provider. This allows the service provider to assign the journey by technical means. The session ID is deleted after the service has been ended.

The data are anonymized and forwarded to our service provider. The service provider uses the data to provide the service and, among other things, to optimise and further develop the service. You may be able to find the service provider's data protection notes (where relevant) on the service provider’s homepage given below: INRIX Inc., 10210 NE Points Drive, Suite 300, Kirkland, WA 98033, USA – www.inrix.com. If you do not agree, you can deactivate the service at any time.

Destination input via myAudi navigation:

This service also uses your myAudi user name. Using your myAudi account and the mobile Internet connection you are using, you can thereby transmit data stored in your myAudi account for the functions of the service to your vehicle via myAudi or synchronise (e.g. with your myAudi account) navigation data stored in your vehicle (e.g. stored navigation destinations, favourites, recent destinations, stored tours, navigation destinations or tours stored in myAudi, search suggestions, settings, etc.). We store the data until you delete them in your myAudi account.

We may use a service provider (HERE Europe B.V., Kenedyplein 222, 5611 ZT Eindhoven, Netherlands) to provide the service.

Automatic Map Update:

With this service, the navigation database can be updated online directly in the vehicle. To do this, the vehicle analyses which regions within a country (e.g. Ontario) are relevant for the vehicle and transmits this information to Audi's IT systems. If the customer agrees, the Automatic Map Update is then delivered and downloaded in the vehicle via Audi's IT systems. All this information is deleted in our IT systems when delivery takes place. We may use a service provider (HERE Europe B.V., Kenedyplein 222, 5611 ZT Eindhoven, Netherlands) to provide the service. The service provider does not receive any vehicle or personal data.

Traffic light information:

If you choose to activate Traffic Light Information service, we collect anonymized GPS data as the vehicle approaches a connected traffic light. In addition, we collect some services related data, such as the crossing timestamp of an intersection to verify and optimize the quality of this service.

We may also use or share your information in an anonymized or aggregate manner for purposes including research, analysis, modelling, safety, product or service improvement, infrastructure change or improvement (such as highway safety improvements, traffic light management, etc.) and aggregated information services such as traffic reporting.

Online roadside assistance:

The following data are used by the online roadside assistance service: the vehicle identification number (with which your vehicle can be clearly identified and attributed to a specific vehicle keeper), the time stamp for data collection, vehicle condition and diagnostic data, in particular mileage, oil level, clean diesel data (number of engine starts and distance remaining), distance remaining and time until next service interval, currently active warning lamps/messages in the instrument cluster, the number of a fault event (including time stamp and mileage for fault entry), fuel tank level, history of warning lamps/messages, charge level of battery, information on whether the driver activated the online roadside assistance with the call button or if he/she performed an online roadside assistance call offered by the system, HMI language setting, location data and direction, seat belt status, severity of crash, location of collision, remaining range and SIM card data.

To provide the online roadside assistance service, we process/use the data mentioned previously. This means that at the time you make an online roadside assistance call and confirm the transmission of the data from the vehicle to the Audi back end, the data and your call are sent to a call centre commissioned by us to deal with roadside assistance calls. However, only the minimum amount of information necessary to process roadside assistance calls properly is sent. The call centre agent receives information from the data sent so that he/she can help as quickly as possible. If necessary for roadside assistance, these data may be given orally to third parties such as towing companies. For documentation purposes, the call centre only stores the conversation history, mileage and vehicle identification number after the call has been completed and the issue dealt with; all other data are promptly deleted.

The service is activated automatically as standard and cannot be deactivated. However, we have ensured that your vehicle cannot be tracked in normal usage because of this service. This means that no electronic tracking can occur. The roadside assistance call can be cancelled again at any time.

Emergency call:

The following data are used by the emergency call service: the vehicle identification number (with which your vehicle can be clearly identified and attributed to a specific vehicle keeper), administration (information on whether the emergency call was made manually or automatically, whether the location information is reliable, the vehicle type and whether the call is an emergency or a test call), vehicle energy storage method (e.g. petrol, diesel, gas etc.), time of the emergency event, number of passengers in vehicle, language setting, severity of crash (measurement points: front, left, right and rear and if the vehicle has overturned), seating positions of passengers, door status. The vehicle positions before and after the emergency event are also stored in the vehicle. The last vehicle position before the most recent time that the vehicle was switched off is always stored in the vehicle, even if no emergency call event is stored. This means that at least the last known location can be transmitted to the call centre if an accident occurs but no current location can be calculated and transferred to the call centre.

The emergency call service is an emergency call that is either made automatically when internal vehicle sensors are activated or manually (by pressing a button) by one or more vehicle occupants. When an emergency call is triggered, the vehicle sends the data specified previously to our call centre, Robert Bosch GmbH, Robert-Bosch-Platz 1, 70839 Gerlingen-Schillerhöhe. The call centre establishes an audio connection between the vehicle occupants and the nearest emergency control centre (police, control room, traffic police) and transmits the data needed for the emergency response onwards as appropriate.

The data for processing of the emergency call are not sent to Audi but directly to the Robert Bosch GmbH call centre. In the vehicle, the individual emergency calls are logged in a ring buffer (limited to data documenting that an emergency call has occurred - not the content of the emergency call) and regularly overwritten. The call centre records the emergency call (voice call) and stores the recording (to allow for possible questions/callbacks in the vehicle) for a short period.

The service is activated automatically as standard and cannot be deactivated. We have ensured that your vehicle cannot be tracked in normal usage because of this service. This means that no electronic tracking can occur.

Audi service request:

This Audi connect service is a personalized service. This means that a separate and individual myAudi account must be registered and opened to use the service. You can configure the service in your myAudi account and transmit certain data and content required for the functions of your Audi connect services to your vehicle and also allow certain vehicle data to be transmitted from the vehicle to us (as described below).

The following data are used by the Audi service request service: the vehicle identification number (with which your vehicle can be clearly identified and attributed to a specific vehicle keeper), the time stamp for data collection, vehicle condition and diagnostic data, in particular mileage, oil level, clean diesel data (number of engine starts and distance remaining), distance remaining and time until next service, currently active warning lamps/messages in the instrument cluster, the number of a fault event (including time stamp and mileage for fault entry), fuel tank level, history of warning lamps/messages and charge level of battery.

To provide the Audi service request service, we process/use the data specified above so that the vehicle can proactively initiate the process of arranging an appointment for the vehicle to be serviced as soon as this is due. After the user has agreed, the vehicle transmits the vehicle condition and diagnostic data as well as the user's contact details (as entered by the user in his/her myAudi account) to the Service Partner specified in his/her myAudi account. The Service Partner then contacts the user by telephone or e-mail to plan the appointment. The data transferred serve to assist with planning. This means that the Service Partner can estimate the scope of the maintenance/repair job, order replacement parts in good time, plan for a replacement vehicle etc.

After the user has given his/her consent and the data have been transferred, the data relevant for the Audi service request service are stored for 3 months in the Audi back end so that an appointment can be arranged in this time.

The service is only activated once the user's profile data have been entered in the user's myAudi account and the user has accepted the data protection notes in the myAudi account. It can be deactivated at any time in the myAudi account during its period of use.

3D city models:

The following data are used by this service: ID of the tile the vehicle is currently in. An anonymized “session ID” is generated to connect the vehicle to the service provider. This allows the service provider to assign the journey to the vehicle by technical means. The "session ID" is deleted after the service has been ended.

The data are anonymized and forwarded to our service provider. The service provider uses the data to provide the service and, among other things, to optimise and further develop the service. myAudi navigation:

The Audi connect service myAudi navigation is a personalized service. This means that a separate and individual myAudi account must be registered and opened to use the service. You can configure the service in your myAudi account via the myAudi app and transmit certain data and content required for the functions of your Audi connect services to your vehicle (via your mobile network connection) and also allow certain vehicle data to be transmitted from the vehicle to your mobile device (as described below).

The following data are used by the myAudi navigation service: Stored destinations (last destinations, favourites, stored tours with time of creation), recording of predictive navigation (likely destinations on the basis of destinations driven to often and the personal routes recorded thus far to these destinations on the basis of the destinations already stored), currently active route guidance (destinations and calculated route). The data are sent from your vehicle to Audi Canada's IT systems, provided by us in the app and added to with destination and route suggestions. Furthermore, the traffic situation on the routes you often use can also be monitored so that you can be notified of possible delays on your route via your mobile device. Your vehicle can access the stored destinations and routes. The data are stored for the validity period of the service and the existence of your myAudi account.

An anonymized “session ID” is generated to connect the vehicle to the service provider. This allows the service provider to assign the journey to the vehicle by technical means. The "session ID" is deleted after the service has been ended. The data are forwarded to our service provider. The service provider uses the data to provide the service. Online radio:

With the online radio service, we use the following data to display an up-to-date station list of the available radio stations: Current country, current system language, market, software version and GPS position of the vehicle. The data are anonymized and forwarded to our service provider. The service provider uses the data to provide the service and, among other things, to optimise and further develop the service.

Online system update:

With this service, we use the following data to provide the service: Vehicle identification number (with which your vehicle can be positively identified and allocated to a specific keeper), software and hardware version and serial numbers of the hardware in order to provide the correct update version. We store these data together with the information on the update provided for vehicle safety and security reasons.

Wi-Fi hotspot:

When this service is being used, we use the following data: MAC address and name of device in use. We store these data in the vehicle so that you can reconnect your device more quickly. The Wi-Fi hotspot may use the data plans service. Please refer to myAudi for information on the data used by this service.

Online navigation:

With the online navigation service, we use the following data to provide the service: Current vehicle position, destination entered in the navigation system and route criteria settings. The best route is calculated and provided to your vehicle on the basis of these data and according to the traffic situation.

An anonymized “session ID” is generated to connect the vehicle to the service provider. This allows the service provider to assign the journey to the vehicle by technical means. The "session ID" is deleted after the service has been ended. The data are forwarded to our service provider. The service provider uses the data to provide the service. Optimization of offers:

In addition and where necessary, we collect various technical function data from the assist systems, convenience systems, controls and/or control units together with ambient data (e.g. outside temperature, brightness) and information on length of the trip, vehicle speed, vehicle condition data (e.g. tank level or charge level, mileage), time of data collection and system usage data. We do this as part of campaigns running for a limited period to optimize our vehicle function offers and to adjust the systems to customer expectations. Positional data and other data are not transferred for these purposes. This relates to technical data on the condition of the vehicle which are transferred using a time-limited "session ID" generated randomly by the vehicle or another pseudonym, depending on the type of campaign. The campaigns are each checked in advance and require a minimum number of participating vehicles. We analyze the data without linking them to a specific driver or user. When doing so, the only data collected for an analysis are those required for the relevant evaluation. The vehicle does not permanently send data. We do not use these data to create profiles or to make evaluations on the basis of individual vehicles. You have the option to temporarily deactivate the transmission of certain types of data from your vehicle in the privacy settings at any time. However, this may limit the function of the connect services. If you wish to permanently (rather than temporarily) disable data transmission from your vehicle for the purposes of offer optimization given above, please contact our customer support.

2. Usage profiles

Insofar as this is permitted by law, we create usage profiles for the purposes of market research or to develop our Audi connect services so they correspond to customer needs. These usage profiles include, in particular, the technical data on the vehicle's condition transmitted to the Audi back end as part of Audi connect. The profiles are either created without reference to a specific person or by using pseudonyms. You can opt out of the use of pseudonyms at any time by contacting auditalk@audi.ca

3. Forwarding to service providers / no distribution to third parties

We use service providers to provide most Audi connect services (see also the information on service providers above) who provide/prepare the relevant content and information for the services. Insofar as is necessary to provide the Audi connect services, we forward the personal data collected and processed as part of Audi connect to the servers of these service providers. If personal data from users in the European Union are affected and transmitted to countries outside the EU/EEA (e.g. USA), we have taken appropriate measures to ensure an adequate level of data protection according to 95/46/EC and/or the EU General Data Protection Regulation 2016/679.

We will not otherwise forward your personal data to third parties unless you have agreed to this or unless we are authorised or obliged to do so because of legal requirements or due to an order by authorities or courts. This can apply in particular when providing information for the purposes of criminal proceedings, danger prevention, or to enforce intellectual property rights.

4. Data security

Data security in the vehicle is a high priority for us. However, if information is transmitted via the Internet as part of Audi connect, the security of these data cannot be guaranteed. Among other things, we use up-to-date technical and organisational measures and currently implement recognised and tested mechanisms and standards from embedded security. We extend the security measures when we develop new functions so that the current data protection policy is fulfilled and so that we can guarantee (through up-to-date technical and organisational measures) the corresponding data security in the vehicle.

5. Changes to this data protection policy
